Substandard SIA assessment
Comment Summary :
- The SIA narrative (Section 4.2) provides broad arguments that do not provide evidence substantiating them from any of the steps applied. In fact, beyond a public consultation summarized as Table 7 which lacks substance; the conduct, results or auditor's assessment of mapping, field observation or in‐depth interviews or other steps are never mentioned again.Table 9 provides a summary of potential impacts that are generally positive but the narrative argument does not provide examples of community views or some research or justification of why local economies will benefit. Much of the steps applied also lack explanation. While it is likely a translation issue it would be quite worrying if the In‐Depth Interviews were done "by interviewing the key socialite who will act as respondents" (sic) (page 16).
- Subrata (see Table 7, page 20) is recorded mentioning the importance of maintaining forests for traditional medicines and construction materials vital to the community. Yet, the HCVs identified in the NPP do not include HCV5/6 on community values. It may be that the comments in Table 7 do not merit HCV5/6 but without elaboration or justification it would be impossible to know. In light of the information inadequacy, the precautionary principle becomes paramount in approving this NPP.
Response from Grower :
- The detailed results of the steps mentioned in page 16‐17 as well as the SIA narrative (section 4.2) are available in the Social Impact Assessment (SIA) report and its appendices. Examples of community views or some research or justification of why local economies will benefit are all available in the full HCV and SIA reports, which have been made available to the NPP auditor during the audit process and has been deemed satisfactory. There is a mistranslation in the statement “by interviewing the key socialite who will act as respondents.", where the "socialite" should have been "social leaders".
- The comment from Subrata during the stakeholder consultation is for information purposes only. According to the assessor’s finding, no HCV 5/6 is identified. This is because to qualify for HCV 5/6 status, a site must provide fundamental and irreplaceable value to the local community. The assessor found that the forest produces mentioned by Subrata (Jelutong and Karayang wood) are widely available in the area surrounding the village (note that Subrata is from Beringin Raya village which is located outside of PT. HAL concession) while the needs for traditional medicine has been replaced by the modern health facility in the village.

- Consultations with communities did not take place as described in NPP documents, and affected communities did not participate in the HCV Assessment and SEIA.
- The HCV Assessment is technically flawed.
- No FPIC process is in place.
- The AMDAL process was not carried out in accordance with the law.
- PT SML has not yet obtained permits that are a prerequisite to land clearing.
Response from Grower :
- The RSPO reviewed the work conducted by the HCV assessors (PT. Sonokeling) and the CB involved in this NPP notification. RSPO asked the company to provide clarifications (by 26/06/2015) on the allegations made by the complainant before the Complaints Panel can be convened and asked to deliver a decision on the matter. The investigation included a HCV peer review and field work, as well as a verification of the AMDAL by the reviewer.
